After a recent court ruling was made by Judge Nicholas G. Garaufis of the U.S. District Court in Brooklyn, it appears U.S. Citizenship and Immigration Services (USCIS) may be accepting new Deferred Action for Childhood Arrivals (DACA) applications. Although many efforts have been made to dissolve the program that has helped more than 800,000 individuals from being deported, there has been significant pushback from lawmakers demanding that the program remain active. As a result of this, approximately 300,000 new applicants could be eligible for the program, according to The New York Times.
In Judge Garaufis’ ruling, he also ordered the Department of Homeland Security (DHS) to restore certain benefits, including permits to work. DHS had issued a memo that limited work permits to only one year, however, Judge Garaufis now wants that to be increased back to the original two years. In addition, he is also ordering that the government “find a way to contact all immigrants who are eligible for the program to inform them of the change.”
How long will the ruling stand?
Because the Trump Administration and other lawmakers could appeal this decision, it is unclear what challenges the program still faces. For now, however, anyone who meets the eligibility criteria and wants to apply for protection under the DACA program should consider taking action now.
Hiring a Texas Immigration Lawyer to Help Apply for Immigration Benefits Such as DACA
Anytime an individual in Texas decides they want to apply for an immigration benefit, they should consider retaining a TX immigration lawyer to help them through the process. The majority of the applications that need to be filed with USCIS are often confusing and require additional documentation. Because the window to apply for DACA could potentially close, it is best to have a lawyer who is familiar with this paperwork help fill out it and get it filed as soon as possible.
In addition to helping with the paperwork, a Texas immigration lawyer can also:
- Keep a DACA applicant up to date with any changes that may occur involving the program.
- Help a DACA applicant understand their legal rights.
- Review and explain any correspondence USICS sends a DACA applicant and help them comply with any requests.
- Take the necessary action if the DACA application is denied.
Now, if an individual has questions regarding the DACA program, wants to apply, or has recently had their DACA application denied, they should contact the Law Office of J.
